The FinCen Residential Real Estate Rule went into effect on March 1, 2026. It mandates that certain real estate professionals report specific residential property transactions to the Financial Crimes Enforcement Network (FinCEN) to increase transparency and deter illicit financial activity in the United States real estate market. It targets non-financed transfers of residential real estate to legal entities or trusts, which are considered higher risk for money laundering because they can obscure the identities of the true owners.
The transfer must be reported if it meets the following criteria:
1. The property is residential real property, such as a single family home, townhome, duplex, triplex, fourplex, or vacant land intended for residential construction.
2. The transfer (sale) is non-financed, meaning no credit is extended by a financial institution subject to anti-money laundering (AML) and Suspicious Activity Report (SAR) obligations. Private lenders without AML obligations are treated as non-financial entities.
3. The property is transferred to a legal entity or trust, including LLCs, corporations, partnerships, estates, and domestic or foreign trusts.
4. No exemption applies, such as transfers due to death, divorce, bankruptcy, easements, certain estate planning transfers, or transfers to highly regulated entities like banks or insurance companies. Transfers to individuals or gift transfers to natural persons are generally not reportable.
The purpose of this new rule is to prevent the anonymous laundering of illicit proceeds through residential real estate, enhance law enforcement and national security investigations, and increase transparency in high-risk real estate transactions. The penalties for noncompliance are significant!
